Labour law — drafting bylaws, rulebooks, decisions, rulings, warnings and similar documents for a company’s employees. Representation before the courts of the Republic of Macedonia in labour disputes.
Workers’ rights
The law guarantees workers a wide range of rights, for which they may seek judicial protection in the event of a violation, including:
- Protection from unfounded grounds for terminating an employment contract — filing a lawsuit on account of approved leave, pregnancy and the like;
- The right to annual leave;
- The right to remuneration — salary;
- The right to salary allowances established by law;
- Special protection during pregnancy and rights related to pregnancy, childbirth and parenthood.
Discrimination
The Labour Relations Act, the Act on the Prevention of and Protection from Discrimination, and the Act on Equal Opportunities for Women and Men all prohibit discrimination.
To that end, we represent clients who claim to be victims of discrimination, and we also defend persons accused of discrimination.
Direct and indirect discrimination
The principle of equal treatment entails the prohibition of direct and indirect discrimination. On that basis, our office provides legal assistance in proving such cases and representing clients in the related proceedings.
Harassment and sexual harassment
Harassment and sexual harassment are also forms of discrimination. Harassment is understood as any unwanted conduct that violates a person’s dignity.
Sexual harassment is understood as any unwanted conduct of a sexual nature, expressed physically, verbally or non-verbally.
Psychological harassment (mobbing)
Psychological harassment (mobbing) of a worker is prohibited by law and elevated to the level of a form of discrimination. Our office provides legal assistance and representation in proceedings for protection from mobbing.
Discrimination against persons with mental and physical disabilities
Discrimination against persons with mental and physical disabilities is understood as the deliberate prevention or restriction of their rights and freedoms.
Inciting and encouraging discrimination
The law also prohibits any activity by which a person directly or indirectly incites or encourages discrimination.
Claims of age discrimination
It is unlawful for an employer to discriminate against a worker on the basis of his or her age, except in cases established by law. Examples:
- holding a stereotype towards certain people because of their age;
- dismissing a worker because of their age;
- requiring a minimum period of work experience for a particular job, even though, given the nature of the work, this is not justified.
The law protects job applicants and workers regardless of how long they have worked. We have successfully provided legal assistance and representation before the authorities in relation to claims of age discrimination.
Equal pay for men and women
Women and men must be afforded equal opportunities and equal treatment in respect of many aspects of the employment relationship, including pay.
We have experience representing clients who claim that, for the same work and with equal job requirements, they receive different pay compared with colleagues of the opposite sex.
